Terms & Conditions

§ 1 Scope

These Terms & Conditions apply to all contracts for courier, transport, and fulfillment services between CROW | Berwanger & Lühr GbR ("CROW") and its customers, unless otherwise agreed in writing. Any deviating, conflicting, or supplementary terms of the customer do not become part of the contract unless CROW expressly agrees to them in writing. The formation and performance of a transport order are subject to the German Commercial Code (HGB) in its applicable version, except where these Terms provide otherwise, as well as to these Terms.

§ 2 Formation of Contract

A contract is formed as soon as CROW expressly accepts a transport order (by phone, email, registration form, or online portal), or accepts it through actual performance. Information on the website, in particular regarding prices and availability, is non-binding and does not constitute a binding offer by CROW.

§ 3 Scope of Services & Performance

CROW transports shipments exclusively by cargo bike within the core delivery area of Berlin as stated in the pricing overview, and beyond by separate agreement. The exact scope of services (pickup, transport, delivery, additional services such as scheduled windows, documented delivery, storage fees, etc.) follows the price list valid at the time of order at crowberlin.de/en/#pricing. Transport is carried out by CROW's partners, by couriers employed by CROW, and occasionally by subcontractors engaged by CROW, on the basis of the HGB and these Terms.

§ 4 Prices & Payment Terms

Prices published on the website at the time of order apply, net plus applicable statutory VAT. Invoices are due within 7 days of the invoice date without deduction, unless otherwise agreed. Registered customers with an active SEPA mandate receive a 2% discount on the net invoice amount, applied automatically to the direct debit.

§ 5 Packaging & Labeling

The customer is responsible for ensuring shipments are packaged safely and appropriately for transport and content. Fragile, temperature-sensitive, or otherwise especially vulnerable goods must be labeled and packaged accordingly. CROW is not liable for damage resulting from inadequate or unsuitable packaging.

§ 6 Special Additional Services

Cash Outlay: If CROW advances cash on the customer's behalf (e.g. for cash-on-delivery or purchases), this is billed per the price list valid at the time of booking, per €50 outlay. The customer reimburses advanced amounts without delay with the next invoice.

Storage Fee: If a shipment is temporarily stored with CROW at the customer's request, this is done on an insured basis and billed per the price list, per night and per shipment.

Documented Delivery: For this additional service, the courier reads and verifies the document against the copy and signs the verified copy. At the customer's request, CROW will, if necessary, testify in court that the signed document was delivered.

Surcharge Outside Business Hours: Deliveries outside regular business hours and on public holidays in Berlin are available on request only and are billed at a 50% surcharge on the net price per the price list.

§ 7 Performance of the Transport Order

The transport order is deemed complete and performed once the shipment has been delivered to the authorized recipient. At the customer's express request at the time of booking, pickup and/or delivery of the shipment is confirmed by the signature of the sending and/or receiving person, including on behalf of companies and legal entities. Recipients are free to inspect the shipment for damage upon receipt, in the presence of the courier; the burden of proof for any later complaint lies with the customer.

§ 8 Undeliverable or Uncollectable Shipments

If a shipment cannot be collected or delivered, CROW will attempt to consult the customer on how to proceed. If pickup is not possible, the transport order is deemed complete; the resulting failed attempt is charged at a minimum of the base price for a transport order under the price list valid at the time of booking, and is payable by the customer.

§ 9 Liability

For loss of or damage to transported goods, CROW is liable in accordance with the statutory provisions of German commercial freight law (§§ 407 ff. HGB), in particular the liability caps set out there, unless intent or gross negligence applies. For indirect damages, lost profit, or pure financial losses, CROW is liable only in cases of intent or gross negligence. Goods with a value exceeding the usual scope must be declared separately prior to booking; additional transport insurance can be arranged for such goods.

§ 10 Dangerous Goods & Excluded Items

Goods whose transport is subject to statutory restrictions are excluded from transport unless a separate agreement has been made (e.g. UN3373-certified biological specimens as described in the Medical section). The customer must inform CROW of any characteristics of the shipment relevant to transport, storage, or safety prior to handover.

§ 11 Delivery Times

Stated delivery times and time windows ("Standard", "Precise") are non-binding estimates unless expressly agreed as binding. CROW is not liable for delays due to force majeure, traffic obstructions, extreme weather, or other circumstances beyond CROW's control.

§ 12 Complaints

Visible damage or loss must be reported to CROW without delay, at the latest within 24 hours of delivery or scheduled delivery. Later notifications may impede or exclude the enforcement of claims.

§ 13 Limitation Period

The limitation period for claims arising from the transport order begins upon the claim becoming due, at the latest upon delivery of the shipment; in the case of loss, upon becoming aware of the loss.

§ 14 Data Protection

Our Privacy Policy applies to the processing of personal data in connection with the performance of the contract.

§ 15 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for all disputes arising from or in connection with this contract is, where legally permissible, Berlin. Should individual provisions of these Terms become invalid, the validity of the remaining provisions remains unaffected.
